Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The Landlord withdrew the application for persistent late payment, and the LTB consented to the request. The LTB found that the Landlord served a valid N4 Notice and the Tenant did not void the notice by paying the arrears.
Landlord's representative disputed the Tenant's claims about maintenance issues and argued the proposed payment plan is unreasonable.
Tenant proposed a payment plan of $700 per month to pay the outstanding arrears.
Tenant testified to maintenance issues in the rental unit pertaining to the disrepair of stairs in the front porch and in the kitchen, and claimed the disrepairs caused injuries to his thumb.
