The Tenant proved the allegations in the application on a balance of probabilities. The Landlords must pay the Tenant $1,507.57, which includes compensation for illegal entries, replacement of disposed property, and harassment. The tenancy is terminated as of December 1, 2022.
Tenant applied for an order determining that the Landlords entered the rental unit illegally, substantially interfered with the reasonable enjoyment of the rental unit, and harassed, obstructed, coerced, threatened or interfered with the Tenant.
Landlord Ms. Hillman-Burton testified that she did not see all of the items on the Tenant's list, only a few screwdrivers, a red toolbox, and a few other tools. The Landlord also agreed they currently have the leaf blower.
Tenant went to Walmart on May 28, 2022 and when she returned, numerous personal items were gone as the Landlords had people come that day to remove junk from the basement which the Tenant agreed to but she did not agree for anything in the garage to be removed.
