The Tenants' application is dismissed. The Landlord has rebutted the presumption of bad faith by showing he genuinely intended to occupy the unit after the Tenants vacated.
Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith. The Tenants claimed the Landlords did not move into the rental unit after they vacated as required by the N12 notice.
Landlord testified he moved into the unit after Tenants vacated and occupied it for 13 months.
Tenants observed 'for rent' sign in window and Kijiji ads for their former unit shortly after vacating.
