The Sub Tenant shall move out of the rental unit on or before November 26, 2021. The Sub Tenant shall pay the Landlord $53.00 for the cost of filing the application. If the unit is not vacated by November 26, 2021, then starting November 27, 2021, the Landlord may file this order with the Court Enforcement Office (the Sheriff), so that the eviction may be enforced.
The Sub Tenant applied for an order to terminate the tenancy and evict the Landlord, and for compensation for the use of the rental unit. The Landlord owns a trailer home in a mobile home park and rented it to the Sub Tenant on October 30, 2019 for six-month terms that were repeatedly renewed. The Landlord introduced evidence of a signed agreement to terminate the tenancy on April 30, 2021, which the Sub Tenant disputed. The Tribunal found that the termination date was agreed to by the parties and the subtenancy ended on April 30, 2021.
The Landlord points out that the different colour ink is also on additional terms that were added as well as the same coloured ink used to sign the document.
The Tenant testified he did not agree to the termination date and points to the different colour ink on the termination date.
