Tenant's T6 and T2 applications granted. Landlord ordered to pay Tenant $2,920 in rent abatement and $90 for application filing fees, for a total of $3,010. Landlord must pay Tenant by February 21, 2022, or will owe interest.
Tenant filed T6 application alleging Landlord failed to maintain rental unit in good repair and T2 application alleging Landlord harassed Tenant, entered rental unit illegally, and substantially interfered with Tenant's reasonable enjoyment. Tenant moved in on December 23, 2019 and vacated on August 21, 2020.
Landlord argued Tenant was aware of rental unit's condition before moving in and prior tenants did not complain.
Landlord acknowledged receiving Tenant's notice about mold but only advised Tenant to use bleach. Landlord also illegally entered rental unit on two occasions without proper notice.
Tenant discovered mold in rental unit in January 2020 and notified Landlord. Tenant also observed other maintenance issues like rotting skirting and leaking roof.
