Citation: Hastings Local Housing Corp. v Palmer, 2022 ONLTB 5203
File Number: LTB-L-019240-22
Hearing Date
Jul 2022
Order Date
Sep 2, 2022
Tenancy End Date
Sep 2022
The tenancy is terminated effective September 21, 2022. The Tenants must vacate the rental unit by that date. If they do not, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenants must also pay the Landlord $186 for the application filing fee and daily compensation of $11.80 per day starting September 8, 2022 until they move out. If the full amount is not paid by September 21, 2022, the Tenants will owe interest at 3% annually on the outstanding balance.
Landlord applied to terminate the tenancy and evict the Tenants due to allegations that the Tenants or another occupant committed an illegal act involving the production, trafficking or possession of illegal drugs for the purpose of trafficking, and that their actions seriously impaired the safety of other persons in the residential complex.
Tenants argued the charges against them would be dropped and they were charged on a 'precautionary basis', but provided no evidence to support this.
Tenants claim they were not involved in drugs and that their guest was responsible, but this was not found to be plausible.
