The tenancy between the Landlord and the Tenant is terminated effective December 19, 2024. The Tenant must move out of the rental unit on or before December 19, 2024. The Tenant shall also pay the Landlord compensation of $32.55 per day for the use of the unit starting October 23, 2024 until the date the Tenant moves out of the unit less any payments made toward rent. The Tenant shall also pay to the Landlord $186.00 for the cost of filing the application. The Landlord owes $951.85 which is the amount of the rent deposit and interest on the rent deposit.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant, another occupant of the rental unit or a person the Tenant permitted in the residential complex has seriously impaired the safety of any person and the act or omission occurred in the residential complex.
Landlord's agent testified that the Tenant approached her, shouted at her, blocked her path, and raised his fists in an attempt to strike her, but was prevented from doing so by a third party.
Tenant argued that he was just trying to speak to the Landlord's agent about noise issues in the building, and that he did not swear or physically threaten her.
