The tenant shall pay the landlord $15,336, which includes rent arrears up to August 31, 2023 and the cost of the application. If the tenant does not pay the full amount by September 8, 2023, they will start to owe interest at 6% annually on the outstanding balance. The stay imposed by the set aside motion related to the previous order LTB-L-025792-23 is lifted immediately.
The landlord applied for an order requiring the tenants to pay the rent they owed and because the tenants entered into an agreement to terminate the tenancy. The tenants had not paid rent for 23 months.
Landlord introduced evidence of a video showing the landlord explaining the N11 form to the tenants and them signing it, as well as a full release signed by the tenants for which they received $3,400 in compensation.
Tenants requested an adjournment to seek legal assistance.
