The Landlord's application to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant was granted. Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord alleged that the Tenant's rental unit was in a deplorable state, with garbage, food waste, and a foul odor that negatively impacted other tenants in the building.
Landlord attended the rental unit on three separate occasions and observed the unit to be filled with garbage, refuse, empty bottles and partially eaten food containers with rotting foods, which attracted fruit flies. Landlord gave verbal warnings to the Tenant to clean up, but there was little to no improvement.
Tenant's rental unit was in a deplorable state, with garbage, food waste, and a foul odor that negatively impacted other tenants in the building.
