Citation: Kanagaratham v Boston, 2024 ONLTB 9593
File Number: LTB-L-076172-23
Application Date (Estimate)
Jul 2023
Hearing Date
Jan 2024
Order Date
Feb 5, 2024
Tenancy End Date
Feb 2024
We estimate Application Date using rent arrears.
Unless the Tenants void the order by paying $35,386 on or before February 16, 2024, the tenancy will be terminated. If the Tenants do not void the order, they must pay the Landlords $24,376.40, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenants must also pay daily compensation of $144.66 for each day of occupation starting January 17, 2024 until they move out.
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.
Tenant testified that in January 2023, he got in a car accident which made his vehicle unusable. Since then, he had been sharing a vehicle with his child's mother but with only one car, it was difficult to get to work. The Tenant ended up working less as a result. This triggered personal issues for the Tenants, and he was unable to pay the rent.
