The tenancy is terminated unless the Tenants pay $45,292 by June 22, 2024 to void the order. If the Tenants do not void the order, they must pay $35,186 to the Landlord and vacate the unit by June 22, 2024. If the unit is not vacated, the Landlord may file the order with the Sheriff for enforcement starting June 23, 2024.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Tenant submitted a payment plan which the Landlord objected to, in part, because the payments were based on speculative future income.
Tenant Juslyn Francois testified that she has two young children, one of whom uses a wheelchair, and it would be very difficult for her to find an appropriate, accessible new place to live. She was recovering from injuries and could not repay the arrears at the time, but anticipated receiving significant additional funds from employment, a tax refund, and government sources.
