The tenancy is terminated effective January 29, 2023. The tenant must vacate the unit by that date. If the tenant does not vacate, the landlord may file the order with the Sheriff to enforce the eviction. The tenant must pay the landlord $186 for the application filing fee.
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's behavior that substantially interfered with the reasonable enjoyment of the residential complex, committed illegal acts, and seriously impaired the safety of others.
The landlord argued that the tenant's actions warranted termination of the tenancy and that relief from eviction should not be granted due to the serious nature of the tenant's behavior.
The landlord's staff felt unsafe and fearful when dealing with the tenant, either in person or on the phone. The tenant's aggressive and abusive behavior, including physical contact with staff, substantially interfered with the reasonable enjoyment of the residential complex and seriously impaired the safety of others.
The tenant was seen throwing garbage and other items from his 14th floor balcony, which could have harmed anyone walking below. The tenant also physically pushed and assaulted staff members on multiple occasions.
The tenant's aggressive and abusive behavior, including physical contact with staff, throwing items from the balcony, and other disruptive actions, substantially interfered with the reasonable enjoyment of the residential complex and seriously impaired the safety of others.
