The Landlord is responsible for repairing the crawl space basement wall and must do so by January 31, 2025. If the Landlord does not complete the repairs by the deadline, the Tenants can deduct 100% of the rent until the work is done. The Landlord must also pay the Tenants $13,596.02 for rent abatement and reasonable out-of-pocket expenses incurred.
Tenants applied for an order determining that the Landlord failed to meet their maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The dispute centered around the responsibility for repairing the crawl space basement of the mobile home site.
Landlord was unaware of the flooding issue until contacted by Tenants' representative on October 16, 2023.
Tenants have been pumping water from the basement since 2003 due to ongoing flooding issues.
