The Landlord served a valid N4 Notice and the Tenant did not void the notice by paying the rent arrears. The Tenant was still in possession of the rental unit at the time of the hearing. The Board granted relief from eviction and ordered the Tenant to pay the rent arrears of $10,841 in a payment plan, with the first payment due on May 15, 2024.
Tenant lost job and struggling to get finances in order, has job interview coming up, and prefers to stay in rental unit as kids' school and community are nearby
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.
Landlord's Legal Representative stated it is a short-term tenancy, Tenant attempted to make payments but was unsuccessful, and Tenant has ongoing financial problems. Landlord's Legal Representative said Tenant was unable to tell them how much they can pay monthly.
Tenant submitted they lost their job and have been struggling to get their finances in order. Tenant said they have a job interview coming up and if successful, will be able to enter into a payment plan to pay an extra $700 towards the arrears on top of the monthly rent.
