The tenancy is terminated effective July 16, 2023. The Tenants must move out by that date and pay the Landlord $5,158 for use of the unit from February 1 to June 13, 2023, plus $46.03 per day from June 14, 2023 until move-out. If the Tenants do not pay the full amount by July 16, 2023, they will owe interest at 6% annually on the outstanding balance.
Unfair to grant relief from eviction
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord currently living with brother, relationship has become acrimonious. Landlord wants to move into rental unit for his own personal use.
Tenant no longer responds to Landlord's calls or text messages after N12 notice was served.
