File Number: CEL-04262-21
Application Date

Hearing Date
Feb 2022
Order Date
Feb 28, 2022
Tenancy End Date
Mar 2022
The tenancy is terminated effective March 11, 2022. The Tenant must pay the Landlord $6,396.96, which includes rent arrears up to February 28, 2022 and the cost of filing the application, less the rent deposit and interest owed on the deposit. The Tenant must also pay $57.21 per day for compensation for use of the unit starting March 1, 2022 until the Tenant moves out. If the Tenant does not pay the full amount owing by March 11, 2022, the Tenant will start to owe interest at 2% annually on the outstanding balance. If the unit is not vacated by March 11, 2022, the Landlord may file the order with the Sheriff for enforcement.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord's Agent requested 11-day order with expedited Sheriff's enforcement provision.
Landlord's Agent stated she left several messages in the Tenant's mailbox to initiate discourse about possible repayment, but received no reply from the Tenant.
Tenant requested 30-day voidable order.
Tenant cited COVID-19 impact on employment as reason for rent arrears.
