The Tenants' request for a review is granted. The initial order is cancelled and replaced. The tenancy is terminated as of March 26, 2021 when the Tenants vacated the unit. The Tenants must pay the Landlords $20,860.12, which includes rent arrears, compensation, and the application fee, less the rent deposit and interest owed on the deposit. The Landlords must provide the Tenants access to the rental unit to retrieve their belongings.
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit on March 26, 2021, prior to the review hearing date.
The review request is an abuse of process and contrary to section 74(14) of the Residential Tenancies Act.
Tenants did not receive notice of the initial hearing and only learned about the proceedings after being evicted.
